Welcome to www.piziste.com (the “Site”).
These Terms & Conditions (“Terms”) govern your access to and use of the Site, including any content, features, tools, and services offered by piZiste International Private Limited (“piZiste”, “we”, “our”, or “us”).
By accessing, registering, or using the Site, you agree to be bound by these Terms, our Payment Terms, Privacy Policy, and any additional policies referenced herein (collectively, the “Agreements”). If you do not agree, you must not access or use the Site.
1. Eligibility
- piZiste is available only to individuals 18 years or older.
- By using the Site, you confirm that you are legally capable of entering into a binding contract under Indian law.
- If you are using piZiste on behalf of an entity, you confirm you are authorized to bind that entity.
2. Definitions
- Buyer: A user who purchases freelance services on piZiste.
- Seller: A user who offers freelance services through piZiste.
- Service: Any freelance service listed by a Seller.
- Order: A confirmed purchase between Buyer and Seller.
- Custom Offer: A tailored proposal created by a Seller.
- Order Page: The workspace where Buyers and Sellers communicate and deliver work.
- UGC (User Generated Content): Any content uploaded by users.
3. Account Registration & Security
- Registration is free.
- Users must provide accurate, complete, and up-to-date information.
- You are responsible for safeguarding your login credentials.
- You are fully responsible for all activity on your account.
- piZiste is not liable for unauthorized access resulting from your failure to protect credentials.
4. Marketplace Overview
- Only registered users may buy or sell services.
- Buyers must pay in advance through piZiste.
- Payments outside piZiste are strictly prohibited.
- Sellers must fulfill orders as described.
- Excessive cancellations or misconduct may result in penalties or account suspension.
5. Seller Terms
5.1 Seller Fees & Earnings
- Sellers receive 80% of the Service price.
- piZiste charges a 20% service fee, automatically deducted.
- Earnings are credited only after Order completion.
5.2 Seller Responsibilities
Sellers:
- Must deliver services exactly as described
- Must own or have rights to deliver the service
- Must not mislead Buyers
- Are responsible for compliance with applicable laws
- Are responsible for taxes, insurance, and liabilities
piZiste may temporarily restrict withdrawals for security or fraud prevention.
6. Prohibited Services
The following are strictly prohibited:
- Illegal or fraudulent services
- Copyright / trademark infringement
- Adult or pornographic content
- Academic cheating services
- Misleading or deceptive services
- Reselling regulated goods
- Low-quality or copied services
- Spam or manipulative services
piZiste may remove any Service without notice and suspend related accounts.
7. Buyer Terms
- Buyers must use piZiste payment systems only.
- Attempting off-platform payments is prohibited.
- Buyers must clearly define requirements.
- piZiste does not guarantee service quality.
8. Orders & Delivery
- Orders are created after payment confirmation.
- Sellers must deliver via the Order Page only.
- Buyers may request revisions as per Service description.
- Orders auto-complete if no response within the defined period.
- Milestone Orders follow milestone-specific rules.
9. Reviews & Ratings
- Reviews must reflect genuine experiences.
- Fake, coerced, or manipulated reviews are prohibited.
- Reviews are public and generally non-removable.
- Abuse of the review system may result in account termination.
10. Communication & Conduct
Users must:
- Communicate respectfully
- Not harass, abuse, discriminate, or threaten others
- Not share personal contact details to bypass the platform
- Keep all files and communication within piZiste
piZiste does not protect off-platform interactions.
11. Intellectual Property
11.1 Ownership
Unless stated otherwise:
- Upon full payment, Buyers receive full IP rights to delivered work.
- Sellers waive moral rights upon delivery.
- Commercial use may require an additional license if specified.
11.2 Platform Use
piZiste may use:
- Service listings
- Usernames
- Delivered work (with no confidential data)
for marketing and promotional purposes without compensation.
12. User Generated Content
Users:
- Retain ownership of UGC
- Grant piZiste a global, royalty-free license to use UGC
- Are solely responsible for uploaded content
piZiste may remove UGC that violates policies.
13. Payments, Refunds & Disputes
All payment-related matters are governed by the Payment Terms.
piZiste is not a party to Buyer–Seller contracts and does not guarantee outcomes.
14. Account Suspension & Termination
piZiste may:
- Suspend or terminate accounts
- Remove Services or content
- Withhold funds where legally required
Reasons include:
- Policy violations
- Fraud
- Abuse
- Illegal activity
15. Disclaimer of Warranties
THE SITE AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE”.
PIZISTE DISCLAIMS ALL WARRANTIES TO THE MAXIMUM EXTENT PERMITTED BY LAW.
16. Limitation of Liability
PIZISTE SHALL NOT BE LIABLE FOR:
- Indirect or consequential damages
- Loss of profits, data, goodwill
- Buyer–Seller disputes
Liability is limited to the extent permitted by applicable law.
17. Governing Law & Jurisdiction
These Terms are governed by the laws of India.
Courts of Mumbai, Maharashtra shall have exclusive jurisdiction.
18. Changes to Terms
We may update these Terms at any time.
Continued use of the Site constitutes acceptance.
